No response was received within the legal deadline of 30 days. Administrative silence. I therefore had to refer the matter to the Commission d&#8217;acc\u00e8s \u00e0 l&#8217;information (CAI), as provided for by law.<br>Reference: <a href=\"https:\/\/ici.radio-canada.ca\/nouvelle\/2177546\/north-hatley-acces-information-transparence\">North Hatley will have to defend itself before the Access to Information Commission (Radio-Canada)<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">What happened next? A perfect demonstration of administrative exhaustion:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Three hearings scheduled by the CAI;<\/li>\n\n\n\n<li>The municipality shows up with a lawyer paid for by taxpayers;<\/li>\n\n\n\n<li>Hearing postponed at the last minute (48 hours before), without valid reason;<\/li>\n\n\n\n<li>Obligation to hire a lawyer myself: $1,000 already out of my pocket just to enforce a right provided for by law.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-4-3 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Access to information: in North Hatley, an obstacle course\" width=\"640\" height=\"480\" src=\"https:\/\/www.youtube.com\/embed\/G859_6fSuVw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">15 months later, still nothing!<\/h2>\n\n\n\n<p>Fifteen months later, I still haven&#8217;t received the requested documents. Instead, I&#8217;ve received a list of excuses: the town hall moved\u2026 the archives can&#8217;t be found\u2026 the fire in 1975\u2026 In short, anything but answers.<\/p>\n\n\n\n<p>I have now been told that I may receive a response on November 17, 2025, nearly a year and a half after my request. And if this response is incomplete, a new hearing will be held in January 2026, this time before a judge, with three hours allocated per case. The estimated cost of defending myself: $4,000 to $6,000. All to obtain\u2026 public documents!<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Meanwhile, who pays?<\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Part of the audience<\/th><th>Who pays?<\/th><\/tr><\/thead><tbody><tr><td>Municipal attorney<\/td><td>Taxpayers (including me)<\/td><\/tr><tr><td>Municipal manager<\/td><td>Taxpayers (including me)<\/td><\/tr><tr><td>Manager at the CAI<\/td><td>Taxpayers (including me)<\/td><\/tr><tr><td>My attorney<\/td><td>Me<\/td><\/tr><tr><td>My working hours<\/td><td>Me<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion?<\/strong> <\/h2>\n\n\n\n<p>The right to access information exists\u2026 but only for those who have the money, time, and energy to fight for it. The rest give up.
