The goal is to clarify <strong>what actual power residents have<\/strong> when a minor variance is submitted.<\/p>\n\n\n\n<p>According to ChatGPT:<\/p>\n\n\n\n<p><strong>Short answer: Yes\u2026 but only partially.<\/strong><br>Residents may express opposition, but the Council is <strong>not legally required<\/strong> to follow it. The municipal council decides alone<\/h2>\n\n\n\n<p>After the public hearing, the Council deliberates and votes.<\/p>\n\n\n\n<p>It may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>approve the variance,<\/li>\n\n\n\n<li>refuse it,<\/li>\n\n\n\n<li>or (rarely) modify it.<\/li>\n<\/ul>\n\n\n\n<p>Even if all citizens present oppose it, the Council is still <strong>legally free<\/strong> to approve the request.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. But residents\u2019 input does have real influence<\/h2>\n\n\n\n<p>Even if not binding, citizen participation can significantly influence the process.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">a. Influence on elected officials<\/h3>\n\n\n\n<p>Ignoring repeated citizen concerns can be politically damaging.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">b. Administrative record<\/h3>\n\n\n\n<p>Well-prepared objections become part of the official file.<br>They may be used in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>complaints to the CMQ (Commission municipale du Qu\u00e9bec),<\/li>\n\n\n\n<li>administrative reviews,<\/li>\n\n\n\n<li>urban planning challenges,<\/li>\n\n\n\n<li>compliance assessments.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Legal requirements still apply<\/h2>\n\n\n\n<p>The Council must be able to justify that the variance:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not negatively affect neighbours,<\/li>\n\n\n\n<li>respects the intent of the zoning by-law,<\/li>\n\n\n\n<li>does not create serious prejudice,<\/li>\n\n\n\n<li>applies to an existing situation or genuine constraint.<\/li>\n<\/ul>\n\n\n\n<p>If a variance is granted despite strong opposition <strong>and<\/strong> without adequate justification, it may be contestable (judicial review, complaint to the MAMH, CCU, etc.).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5.
