La loi <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/A-2.1\" target=\"_blank\" rel=\"noreferrer noopener\">Loi sur l\u2019acc\u00e8s aux documents des organismes publics et sur la protection des renseignements personnels<\/a> pr\u00e9voit un d\u00e9lai de r\u00e9ponse de 20 jours ouvrables, avec la possibilit\u00e9 d\u2019une prolongation (g\u00e9n\u00e9ralement jusqu\u2019\u00e0 10 jours suppl\u00e9mentaires).<\/p>\n\n<p>There are some exceptions. A refusal may be invoked if the documents contain, in particular:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>personal information<\/li>\n\n\n\n<li>trade or business secrets<\/li>\n\n\n\n<li>legal opinions<\/li>\n\n\n\n<li>documents related to a pending decision<\/li>\n<\/ul>\n\n<p>However, any refusal must be supported by a written explanation, citing the applicable provisions of law.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">Same scenario as in 2025 in North Hatley<\/h2>\n\n<p>In my case, on February 10, 2025, I filed a request to obtain the public contract between Location des Quatre Lacs and the municipality of North Hatley regarding the management of the marina.<\/p>\n\n<p>This document was finally sent to me\u2026 the day before my hearing before the Commission d\u2019acc\u00e8s \u00e0 l\u2019information, more than 12 months after my initial request.<\/p>\n\n<p><strong>Let\u2019s recall a similar scenario reported by Radio-Canada in 2025.<\/strong><br\/><a href=\"https:\/\/ici.radio-canada.ca\/nouvelle\/2177546\/north-hatley-acces-information-transparence\">https:\/\/ici.radio-canada.ca\/nouvelle\/2177546\/north-hatley-acces-information-transparence<\/a><\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">Two conclusions can be drawn:<\/h2>\n\n<ul class=\"wp-block-list\">\n<li>either the contract was exceptionally difficult to locate or process;<br\/><\/li>\n\n\n\n<li>either they counted on the applicant to give up, hoping he wouldn&#8217;t see the process through to the end.<br\/><\/li>\n<\/ul>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">A lengthy process for a simple public document<\/h2>\n\n<p>Enforcing this right does indeed require perseverance: filing a complaint with the Commission, filling out forms, preparing the case file, attending a hearing\u2026<\/p>\n\n<p>By way of comparison, similar requests submitted to the Township of Stanstead and the Township of Hatley were processed in less than 24 hours, accompanied by a courtesy call from senior management to confirm that the documents provided adequately met my expectations.<\/p>\n\n<p>Am I the only one?<\/p>\n\n<p><strong>Maybe! <\/strong> <\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n<p>In my view, when it takes 1 year and 27 days\u2014or 392 days\u2014a hearing, and quasi-judicial procedures to ensure that a fundamental right is upheld, this is no longer merely an administrative delay, but a matter of governance.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Access to information is a fundamental right that allows any citizen to obtain public records held by a municipality.
